A signed rental agreement and a non-refundable deposit of (50%) of the total rental cost is required to reserve a date for an event. Should the rental be cancelled for a reason not addressed in this rental agreement, the renter will forfeit the deposit.

Rental Period

​

The standard rental period is for eight (8) hours, between 10:00 am to 10:00 pm of the same day. The rental time period can be adjusted if requested. All adjustments to the standard rental period must be agreed upon by both parties and specified in the rental information document. Depending on th time requested, delivery charges and game cost could differ from the rental information. The renter is responsible for safely storing the games from the start of the event until they are picked up.

Rental Security Deposit

​

A security deposit of two hundred fifty dollars ($250.00) will need to be collected from the renter and held until the games are picked-up and confirmed to be in the same condition they were delivered. This security deposit will be used to repair any damage outside of normal wear and tear should it occur. The security deposit will be returned by check or Venmo after the games have been picked up. Should the renter be unavailable at the end of the event, the deposit will be mailed or sent via Venmo to the renter in a timely manner, no longer than one (1) week after the conclusion of the event.

Final Payment

​

The final payment in the amount of the outstanding balance is due one (1) week from the date of the event. The games will not be delivered and setup if final payment is not received prior to the start of the event. Cash, Check or Venmo are the preferred methods of payment. Personal checks will be accepted, only if received two weeks prior to the event date.

Inclement Weather

​

In the event of inclement weather, it is the responsibility of the renter to ensure the games are moved inside to protect them from sustaining any damage. In the event of inclement weather prior to the start of an event where the venue does not have an indoor contingency plan, the renter will be provided a full refund of the rental price.

Rental Games Unavailable due to damage or Theft

​

Every attempt will be made to to replace and/or rebuild a lawn game prior to a reserved event, should it be stolen or completely destroyed by the previous renter. However, should a game be unavailable to rent due to damage or theft, the following actions will be taken: An available alternate game will be offered with the rental price adjusted accordingly or a refund will be issued for the game that is unavailable.

Rental Game Denied by Venue

​

The appearance of the games may be slightly different than in the photos, because of wear and tear. The games are subject to wear and tear from normal rental use and may sustain minor cosmetic damage and blemishes during the rental period. The renter is not liable for this type of damage.

Repairable Damage

​

The renter acknowledges that they are liable for any and all repairs required, outside of normal wear and tear, to make the games available to be rented for the next event. The condition of each rental game will be documented before and after the rental period to justify any repair cost that are charged to the renter. The security deposit will be used to pay for any required repairs, any remaining security deposit will be returned to the renter and any additional costs exceeding the deposit will be the responsibility of the renter.

Damage Beyond Repair / Theft of Games

​

Should a rental game(s) be damaged beyond repair or stolen, the renter will be financially responsible for the replacement of the rental game(s). The rental games are made using premium materials, which is both costly and time consuming to replace, not to mention the lost revenue from future events because of damaged or stolen games.

Ladder Golf -  $ 350

Replacement Golf Bolo(s) - $ 5 each

3 Hole Washer Toss Game - $ 400

Replacement washer(s) - $ 2 each

Ring Toss Game - $ 100

Replacement Ring(s) - $ 5 each

Connect Four Game - $ 750

Replacement Wooden Disc(s) - $ 5 each

Large Jenga Game - $ 250

Replacement Storage Box - $ 60

Replacement Jenga Blocks - $ 5 each

Yardzee game - $ 100

Replacement Dice - $ 15 each

Kubb Game - $ 350

Replacement Baton(s) - $ 10 each

Replacement Pawn(s) - $ 15 each

Replacement King Piece - $ 30 

Replacement Mallet - $ 25

Replacement Storage Box - $ 50

Replacement Stakes - $ 5 each

Tabletop Hook Ring Toss - $ 75

Drink Holders - $ 35

In addition to the replacement cost of the rental game(s), the renter will be liable for any financial loss sustained until the rental game is replaced. The financial loss will be calculated from any future scheduled events which would now require a refund and lost rental opportunities due to the game being unavailable.

Dispute Resolution

​

In the unlikely event that a renter is dissatisfied with the rental service provided, they agree to cooperate with the Cape Cod Game Guy to discuss and come to a resolution which satisfies both parties, this can include refunds, discounts, and game substitutions.

Limit of Liability

​

Cape Cod Game Guy and all representatives are only financially responsible and liable for up to but not to exceed the payments and security deposit received from the renter, for the rental price of the games during the rental period agreed upon.

The renter acknowledges that they are solely responsible for assuring that their guests are using the lawn games in a safe and civil manner. The renter agrees that any and all bodily injuries sustained, up to and including death, are the responsibility of the renter and their guests. The renter and guests indemnify and hold harmless Cape Cod Game Guy and all representatives involved from any and all legal action.
